Israeli authorities’ actions to seal the family homes in the occupied West Bank of two Palestinians suspected of attacks against Israelis amount to collective punishment, a war crime, Human Rights Watch said today.This punitive measure, which Israeli authorities have said they will follow by demolishing the homes, comes amid a spike in violence that has cost the lives of 35 Palestinians and 6 Israelis since January 1, 2023. The violence has included Israeli army raids that unlawfully attack Palestinian cities and refugee camps, Palestinian attacks on Israelis, and attacks on Palestinians and their property by Israeli settlers, who rarely face punishment for these crimes.“Deliberate attacks on civilians are reprehensible crimes,” said Omar Shakir, Israel and Palestine director at Human Rights Watch. “But just as no grievance can justify the intentional targeting of civilians in Neve Yaakov, such attacks cannot justify Israeli authorities intentionally punishing the families of Palestinian suspects by demolishing their homes and throwing them out on the street.”

When Israeli forces entered Jenin and eliminated a major terror threat, with only one innocent person killed among nine terrorists, Amnesty International issued a press release filled with false Palestinian accusations and not even reporting Israel's version of the events, culminating in accusing Israel of "apartheid."

Responding to the killing of at least nine Palestinians by Israeli forces during a military raid on Jenin refugee camp this morning, Philip Luther, Middle East and North Africa Research and Advocacy Director at Amnesty International, said:“In the space of just a few hours this morning, Israeli forces killed at least nine people and injured 20 more; blocked ambulances from accessing the wounded; and fired tear gas at a hospital, reportedly causing suffocation injuries to sick children.
The charge that Israel fired tear gas at a hospital came from PA health minister Mai Al-Kaila who absurdly claimed that the IDF "stormed" the hospital and "deliberately" fired tear gas to the children's ward.
Israel's army denied a Palestinian claim that soldiers deliberately fired tear gas at a hospital during a raid in the occupied West Bank on Thursday."No one shot tear gas on purpose at a hospital," an army spokesman told AFP. "But the activity was not far away from the hospital and it is possible some tear gar entered through an open window."

This was an attack that required the involvement of a number of people – to assemble the bombs and obtain the necessary ingredients, smuggle the bombs into Israel and plant them next to their targets.
This is already what is called “terrorist infrastructure,” the kind that likely is affiliated with a known organization, which should have been on the Israeli intelligence community’s watch list.
What this also shows is the need to focus now on establishing a government. The sooner there is a stable government in Jerusalem the sooner Israel will be able to create a clear strategy for how to stop the terrorist wave that is not going away. Fights about ministries and portfolios

Comments like the one made by an Army Radio reporter on Wednesday – that the attack was connected to the pending appointment of Itamar Ben-Gvir as the next public security minister – do not do any good. Neither are appearances at the scene soon after the crime by Ben-Gvir, who promised as presumptive internal security minister to wield an iron fist against terrorism.
After 75 years of statehood that has been marred by wars and terrorist attacks, we do not need to look for excuses for why Arab terrorists want to try and kill Israeli Jews. This has been part of the Israeli story since it was created as an independent state and will, sadly, likely continue as long as some of our neighbors refuse to come to terms with our existence here.
There was terrorism when there were left-wing governments in power and there was terrorism when there were right-wing governments. Israelis have not forgotten, for example, how Benjamin Netanyahu promised to topple Hamas in the Gaza Strip during an election campaign in 2009 and how through 12 consecutive years as prime minister he refrained from ordering the IDF to do so.
Netanyahu was quick to respond to Wednesday’s attack, saying his administration would once again make the country safe. What Israelis need right now is security, not boasting of how the incoming government is going to do things differently. Let’s hope they can put their actions where their mouths are.

One of these draft resolutions - approved by 98 voting in favour to 17 against, with 52 abstentions - was titled “Israeli practices affecting the human rights of the Palestinian people in the Occupied Palestinian Territory, including East Jerusalem” (document A/C.4/77/L.12/Rev.1).
By its terms, the UN General Assembly would demand that Israel cease:
all measures that violate the human rights of the Palestinian people, including the killing and injuring of civilians,
the arbitrary detention and imprisonment of civilians,
the forced displacement of civilians
the transfer of its own population into the Occupied Palestinian Territory, including East Jerusalem”
and that:
“the General Assembly should request the International Court of Justice to render urgently an advisory opinion on the legal consequences arising from the ongoing violation by Israel of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of the Palestinian territory occupied since 1967”.
Vituperative verbal attacks on the Jewish State made by Bangladesh, Venezuela, South Africa, Iran, Libya, Niger, Türkiye, Algeria, Brunei Darussalam, Namibia, Indonesia, Kuwait, Japan, Qatar, Lebanon, Sudan, Malaysia and Yemen, all bastions of civil liberties, ensured Jew-bashing would continue at the United Nations whilst the 100 years-old Arab-Jewish conflict remains unresolved.
THE HISTORICAL, political and legal issues are extremely complex. An Israeli take on them was set out in convincing detail in a recent study by Professor Abraham Sion, which he called, “To whom was the promised land promised?” Sion is a former deputy state attorney of Israel and is a professor emeritus of law at Ariel University. If the world were governed by reason, logic and conscientious adherence to the rule of law, Sion’s book would be a game changer.
He submitted the entire legal process leading to the establishment of Israel to meticulous forensic examination and he demonstrates beyond any doubt that judicial rulings from the UN, the EU, the ICJ and elsewhere have often been at odds with a scrupulous interpretation of their legal basis. Over the past few decades, international bodies have reached a consensus that the West Bank and eastern Jerusalem are Palestinian territories, and that Israeli towns and cities in Judea and Samaria are illegal. Sion uncovers the solid legal building blocks that have been ignored or overlooked and that prove different.
In short, he demonstrates with chapter and verse that the almost universally accepted consensus on Israel’s legal position regarding the West Bank, settlements and Jerusalem is legally flawed.
In undertaking his scrupulous legal analysis, Sion’s original purpose was to ascertain who owned the legal right to the territory of Mandatory Palestine under international law. He identified the two competitors as the Arab nation on the one hand and the Jewish people on the other. Concerned solely with the legal position and not with political or related issues, he set out to establish the legal rights under the international law of both parties.
Sion demonstrates that in concluding that Israel is illegally occupying territory, international bodies never refer to the treaties that shaped the legal structure of the Middle East. He shows that the rights derived from those binding international commitments were still valid when Israel occupied the West Bank.
Sion is not alone in reaching conclusions like these, but of course, they have never been tested openly in any international judicial forum. If in due course the UN General Assembly asks the ICJ for an opinion, how could the court possibly render a valid legal determination without having the issues raised by Sion and many others argued before it?
On the very day that the UN committee voted to appeal to the ICJ for an opinion – November 11 – the ICJ began public hearings in The Hague in a long-running dispute between Venezuela and the former British colony of Guyana on the issue of the border between them. Each party is presenting its case to the court in preliminary hearings scheduled to last until November 22. The proceedings are not only open to the public but they are being videoed and publicized widely on social media.

The right to be free from discrimination is a fundamental principle of human rights law, and all governments are obliged to combat discrimination in all its forms.Antisemitism is the most commonly reported anti-religious hate crime in the United States, which is a crisis we must work to end. Amnesty International has examined in detail two Israeli attacks that must be investigated as possible war crimes because they appear either to have deliberately targeted civilians or civilian objects or to have been indiscriminate attacks. On 5 August 2022, an Israeli tank round struck the house of the alAmour family in Khan Yunis, where 11 civilians were staying, killing Duniana al-Amour, aged 22, and wounding her mother and her sister. Based on its identification of the projectile that struck the house as a “highly accurate” 120mm M339 tank round, and its calculation of the distance between the house and the closest military objects using satellite imagery, Amnesty International believes that the al-Amour family’s house was the intended target of the attack. The killing of Duniana al-Amour and the apparently deliberate targeting of her house must therefore be investigated as a possible war crime.
It does appear that Israel targeted a house. Amnesty says it "found no evidence that any members of the al-Amour family could reasonably be believed to be involved in armed combat. "
This is true. But Amnesty is hiding something - something that they certainly reviewed before writing this report. They are hiding what the ITIC wrote about this attack, that one of the "civilians" in the house was Islamic Jihad's commander of the southern Gaza Strip.
The ITIC is close to the Israeli military. It said that the fatal attack on the Falluja cemetery was from the IDF when even Haaretz assumed it was an errant Islamic Jihad rocket, so it cannot be accused of lying. It is the closest thing we have to an official IDF comment on the incident.
If a senior commander was in the house, it was a valid military target. It is a tragedy but certainly not a war crime.
Amnesty doesn't want you to know that, so they simply don't report it.
In another instance, on 7 August 2022, a missile apparently fired from a drone hit Al-Falluja cemetery in Jabalia, killing five children and seriously injuring another. Based on a review of pictures of the weapon’s remnants, Amnesty International determined that they were consistent with an Israeli guided missile. Unnamed sources from the Israeli army told an Israeli newspaper that a preliminary internal probe conducted by the army into the attack showed that neither Palestinian Islamic Jihad nor the AlQuds Brigades were firing rockets at the time of the attack and that Israel was carrying out attacks on “targets” near the area. Satellite imagery showed that there were no military targets visible in the area 10 days before the attack and residents interviewed by Amnesty International said that none appeared in the intervening period. There are strong indications that the strike on Al-Falluja cemetery was either a direct attack on civilians or an indiscriminate attack where Israel failed to comply with the obligation to take all feasible precautions to distinguish between civilians and fighters.Notice how Amnesty assumes that the Israeli sources are simply lying when they say there were targets in the area. A "target" is likely a member or leader of Islamic Jihad. 10-day old satellite imagery will not find such a target, and residents being interviewed sure as hell will not admit they saw a militant even if they did. Amnesty simply assumes Israel either targeted kids for fun, or didn't check for civilians. It does not even consider that the laws of war say that a military commander can act based on the best intelligence information available at the time - he or she does not have to wait for 100% accuracy. Sometimes, as in this case, the information was not accurate enough and there is a tragedy.
