Meir Y. Soloveichik: Not Everything Is Tisha B’Av
It is with this in mind that we must approach the reaction of many when the Knesset, three days before Tisha B’Av, approved limitations on the Israeli Supreme Court. The Times of Israel immediately presented us with the remarkable headline: “Judicial overhaul opponents see parallel to Tisha B’Av, saddest day in Hebrew year.” Indeed, comparisons to the destruction of the Temple abounded. A meme with the words shisha b’av, “the sixth of Av,” was circulated on the Internet, with the comparison to Tisha B’Av being made even by prominent Israeli writers. Some Israelis announced that though they did not usually fast on the Ninth of Av, they would do so this year to mourn what the Knesset had wrought.

I do not wish to discuss the merits or flaws of the government proposal. Rather I want to make one point only: One cannot compare the tragedies of the Jewish past to a democratic vote by the Israeli Knesset, however mistaken one might believe that vote to be. To make this comparison is to recommit the sin of the spies and their audience among the Hebrews, and to repeat the error of our ancestors in the desert millennia ago. Sharing a meme with the words shisha b’av dangerously demonizes a vast part of the Israeli electorate by comparing voters to the Romans who destroyed Jerusalem. And one can react only with horror to the statement by a Jew that a vote by the Knesset is more worthy of mourning than the deaths of Jews throughout history.

In arguing that the memories of Tisha B’Av obligated him to protect the physical well-being of the Jewish state, what Begin was also implying was that in the story of Israel, some—though not all—of what the Romans had wrought had been undone by the rise of the State of Israel and the miracles that followed. The Temple is not yet rebuilt, and hatred of the Jews still festers, but a rebuilt, united Jerusalem stands under Jewish sovereignty. If those who suffered in the events marked on the Ninth of Av would have been shown images of our own age—a united Jerusalem featuring a Jewish government, a Judean desert in bloom, and Jewish homes rebuilt throughout the Holy Land—they would have rejoiced at this vindication of Jewish yearnings. And if they would have been told that during all this, the parliament of the Jewish state would then vote to limit the ability of a Supreme Court to pronounce administrative decisions as “unreasonable,” their awe would not be diminished by an iota, no matter the flaws or virtues of this vote.

And so it must be stressed—though as I type these words, I still cannot believe that it must be stressed—that however much one might disagree with the Israeli coalition’s agenda, it is not Tisha B’Av. It is not the Holocaust. It is not the destruction of the Temple. It is not the expulsion from England, or Spain. It is not the auto-da-fé. It is not the massacres of the Crusades. To argue otherwise is to desecrate the memory of the martyred and the murdered, the exiled and the expelled, those who died with faith in the future of Jerusalem on their lips, and who would react with wonder at the miracles of our age.
Obama’s Calculated Tolerance of Black Anti-Semitism
I believe Sheila Miyoshi Jager’s account; she has nothing to gain by such a story, while the calculating Obama, determined to leave her because he was sure that as a white woman, she would be a political liability as his wife, made sure in his own memoir, Dreams of My Father, to leave out the Cokely episode, including his failure to condemn Cokely for his charge that “Jewish doctors” were deliberately committing “genocide” on “black babies.” This variant on the medieval blood libel about Jews killing Christian children so as to use their blood in making matzos, was a charge so explosive that it could well have resulted in murderous attacks by credulous African-Americans on Jewish doctors. When Sheila Miyoshi tried to convince Obama to denounce Cokely, he refused. He had decided that if he condemned Cokely, he would lose more support among black antisemites than he would gain in Jewish support. Clearly, Obama did not share the anguish of Jews at such charges, an updated version of the medieval blood libels. He was perfectly willing to pass over in silence Cokely’s disgusting and absurd charge of “genocide” by “Jewish doctors” of “black babies.” Sheila Miyoshi was appalled at Obama’s indecent political calculus, and told David Garrow so; that, she said, was her reason for the breakup. Obama, ever the calculating arriviste, determined to rise high, felt no need to reassure Jews that he stood with them. Instead, his silence about Steve Cokely’s charge suggested he had no interest in condemning even the worst antisemitic charges if to do so might hurt him with a black electorate that was also predominantly antisemitic.

Obama’s betrayal of a longstanding American commitment to veto all anti-Israel resolutions at the UN Security Council, when instead of a veto he had Samantha Power abstain from voting on UN Security Council Resolution 2334, that declared Israeli settlements in the West Bank, where a half-million Israelis lived, to constitute a violation of international law, was bad. An American veto would have killed the resolution. With the Americans not vetoing it, UNSC 2334 passed by a vote of 14-0. But Obama had done worse than that, when as a thrusting young Chicago politician he refused to do the right thing; he never denounced Steve Cokely for his extreme antisemitism, reflected in his charge that “Jewish doctors” practiced “genocide” on “black babies.” Obama’s tolerance of the worst kind of antisemitism was then, and remains, a form of antisemitism.
Antisemitism Still Haunts the European Left
Why the double standard? Why identify and condemn antisemitism from the right but not from within the left’s own ranks?

A large part of the answer sheds light upon a problem for the left not just in France, but in Germany, Spain and the United Kingdom—the other countries covered by the ADL report—as well. In essence, antisemitism is not seen as a pernicious ideology targeting Jews as the root of the world’s ills, but rather as an instrument to be deployed in political conflicts. If antisemitism comes from a source that you would have no truck with anyway—in this case, an organization that believes fervently that Catholic doctrine should lie at the foundations of law and public policy—then there is no hesitation in condemning it, particularly when, as was true with the Civitas episode, there is no mention of Zionism or the State of Israel. But if antisemitism comes from an ally, like Corbyn, then you are duty-bound to deny it and dismiss it as a smear. In such an environment, any analytical consistency and certainly any attempt to point out the glaring overlap between far-left and extreme-right antisemitic tropes—dual loyalty, financial clout, disproportionate political and cultural influence—becomes impossible.

While the ADL report highlights the differences between the four countries under the microscope, there are also some key commonalities. “In all four countries, the two dominant findings were that antisemitism was used in anti-Israel contexts and in anti-capitalist contexts,” it observed. “In anti-Israel contexts, antisemitic themes included (1) accusations that Jewish cabals control politics and media and prevent either criticism of Israel or support for Palestine; (2) Holocaust trivialization as a means of arguing that Palestinians are no less victims today than Jews were during the Holocaust; (3) equating Israel with the Nazi regime, thus demonizing Israel; (4) accusations of antisemitism are in bad faith and employed to silence criticism of Israel. In anti-capitalist contexts, antisemitic themes included (1) Jewish control of financial markets; (2) Jewish obsession with money; and (3) Jewish exploitation of workers.”

The point, however, is that large swathes of the European left are either incapable of recognizing these themes as antisemitic, or they believe that the upsurge in hatred against Jews is solely a result of Israel’s policies towards the Palestinians. “They have learnt nothing from what happened to them in Europe. Nothing,” ranted Tariq Ali, a British far-left leader, at an anti-Israel rally in May 2021. “Every time they bomb Gaza, every time they attack Jerusalem—that is what creates antisemitism. Stop the occupation, stop the bombing and casual antisemitism will soon disappear.”

Ali did not spell out the lesson that he believes the Jews should have learned from the Nazi era, but the implication of his words is that they are receiving their just desserts for dispossessing the Palestinians. And that their choice now is to either give in—and thereby suddenly and miraculously banish antisemitism from public discourse, or to carry on fighting and accept antisemitism as an inevitable consequence. Until this mode of thinking is banished from the left, Jews will have little reason to trust its representatives, even on those occasions when they do condemn antisemitism.

There was a different version of the story reported by wire services:
Jews have burned 28 Arab villagers alive at Eltera, near Haifa, according to a telegram which is reported to have been sent to the UN Security Councll by the Secretary-General of the Arab League (Azzan Pasha).
The telegram declared that during the present cease-fire an eyewitness saw Jews saturate villagers' clothing with petrol and set them alight. The names of 14 of the victims are known.

And the lurid, lying accusations sometimes became headlines with no caveats (Caneberra [AU] Times)


Needless to say, this never happened and it is not even clear that the complaint was really sent to the UN Security Council. The accusation was enough to make it into the newspapers and make people think that Jews are monsters, which was the intent.

Just like today, baldfaced lies are an effective propaganda technique, because people simply do not want to believe that someone has the gall to make up such extravagant lies. 

Meanwhile, there was real terrorism done by the Arab side, meant to cut off any supply of water to Jews in Jerusalem (August 13):




Arab accusations of Jewish terror were, then as now, projections of their own terror attempts and desires.

Interestingly, the Jews in Jerusalem had planned for such an event, and had built their own small but important emergency alternative water pipeline to Jerusalem

The Jews could not rely on anyone else (especially the UN)  to solve any problems, not only the water problem. 

Which is something that Israel needs to keep in mind today as well.

Can “The Whole World” Be Wrong?: Lethal Journalism, Antisemitism, and Global Jihad, by Professor Richard Landes, is a hard but important book to read. 
Landes does no less than directly taking on the orthodoxy of the liberal world that regards Israel as one of the worst human rights violators, that regards supporting the Palestinian cause as the archetype of progressive values, that regards the West as Islamophobic and institutionally racist. He challenges the reader - what if everything you have read is wrong, and I am right? 

The first part of the book goes into some detail on four episodes from the early 2000s. 

It is no surprise that one of those episodes is the  Al Dura affair, which Landes is one of the world's experts in. It was indeed the first blood libel of the new millenium, where the media unquestioningly accepted and promoted the idea that Israeli forces murdered the child Al Dura on TV and in cold blood. The French reporter, Charles Enderlin, who spread the libel wasn't there and he trusted the reporting of a Palestinian cameraman. Hours of footage from the same scene showed it was essentially a soundstage, where Palestinians were play-acting injuries. Yet almost no Western reporters questioned the story, as the Arab media ran the footage non-stop for days.

Occuring only two days after Ariel Sharon's visit to the Temple Mount in 2000, the incident inflamed the Palestinians and the Arab world. Indeed, it would not be inaccurate to call the second intifada the "al-Dura intifada," as it almost certainly was the spark that kept the brand new riots going.And it was all a lie - it is impossible that the IDF could have shot the child from their position. 

The other incidents that Landes examines from the early part of the millenium are 9/11, the Jenin "massacre" that wasn't, and the Muslim world's reactions to the Danish cartoons of Mohammed. Landes uses each of these incidents as springboards into examining the West's reactions, which often were, as he notes repeatedly, stupid. On page after page, Landes gives scores of examples of this stupidity: the reluctance by media to use the term "terrorism," the constant repetition that Islam is peace, the bending over backwards to find fault with Western and specifically Israeli actions and ascribing them the responsibility for Islamist violence.

It is easy to forget the early aughts of this century, but Landes reminds us that just as today we will see Western progressives justify Hamas rockets by asking "what choice do they have?," the reaction to the tsunami of suicide bombing attacks in Israel during the bloody years of 2000-2004 prompted the exact same justifications by the same crowd. 

The other two major parts of the book examine the key players in pushing the bizarre mindset of Western self-blame and bending to the will of the Islamists (whom Landes terms "Caliphators") and the current outlook on the war between the West and apocalyptic Islam - and how the Islamists are winning the battle by disabling their enemy. On the way, Landes expertly analyzes the honor-shame culture and the zero-sum thinking of the Islamists as well as the stupid western tendency to project our own mindset onto them, even as they use our own strengths of self-criticism against us.

Throughout the book, Israel is the canary in the coal mine. By any objective standard, Israel is the most progressive and liberal state ever in an extended state of war. Its successful integration of a 20% Arab population as equals is far more successful than what we see in Paris or Malmo with a much smaller Muslim minority. Yet Israel is regarded, even by those other "enlightened" progressive European elites, as a "shitty little country" that has no right to exist. 

As I said, it is a hard book to read. The amount of information is sometimes overwhelming - and often infuriating. Landes also often peppers the text with gems that demand to be re-read. Happily, he chooses to use footnotes instead of endnotes so one can dig deeper into his often offhand examples.

I have some nitpicks too. I didn't see that he has a glossary of terms, many of which he created, until I finished the book, so one often sees his coinages like "Y2KMind" or "Caliphator" a hundred pages before he defines them in the text. I'm not as convinced as Dr. Landes of the millennialist component of Islamist thinking.  

The tone of the book is often more strident than objective, but it is hard to fault Dr. Landes for that, since the reader is apt to be upset along with the author. There is ample excuse to get angry while reading it.  And while Landes gives some general advice on what the West needs to do in order to recognize and defeat the enemy of Islamism, I wish it was more actionable. (I have written and spoken about how I think the Arab honor/shame culture can be used to Western advantage.) 

In general, though, this is an important book to read, and even those of us who are immersed in these topics will learn a great deal and see connections that we hadn't thought of before.

The Second IDF International Conference on Laws of Armed Conflict (LOAC)  took place in Tel Aviv in April, 2017.  The keynote address delivered by Emeritus Professor Yoram Dinstein, former Tel Aviv University president who is recognized as one of the world's leading experts on the laws of armed conflict.

His speech is an excellent overview of the topic. It was published in the Vanderbilt Journal of Transnational Law.

Here are some excerpts where he describes how "human rights" NGOs and the media do not understand the  functions and importance of the laws of armed conflict.

Here he discusses the differences between the laws of war and human rights law.
Another pernicious confusion is spawned by the dual existence in armed conflict of human rights law and LOAC. Naturally, there is some synergy and even a degree of overlap between the two branches of law. The prohibition of torture, which is reiterated in both bodies of law, is a leading example of such overlap. But human rights law and LOAC do collide head-on in certain critical areas. The archetypical case in point relates to recourse to force. Put in a nutshell, the pivotal question is whether lethal force can be used as a first resort or only as a last resort. In ordinary law enforcement (police) action in peacetime, lethal force can be employed against law-breakers only as a last resort. Conversely, in the course of hostilities forming part of an armed conflict, lethal force can be used against enemy combatants as a first resort on a 24/7 basis. When human rights law and LOAC clash - as they do in this respect - LOAC must prevail over human rights law because - as recognized by the International Court of Justice and other tribunals - it is the lex specialis

The trouble is that zealous advocates of human rights law are not willing to yield the moral high ground. They behave like the high priests of a Holy Gospel who regard any deviation from their received dogma as apostasy. They fail to appreciate the special nature of armed conflict and therefore contest the overriding force of LOAC. They ignore the fact that LOAC - which is directly responsive to the unique features of warfare - is a product of a pragmatic compromise between military necessity and humanitarian considerations. They think that, by rejecting military necessity, they will lead us to utopia. But what they are liable to bring about is dystopia. If international law were to ignore military necessity, military necessity would ignore international law. Belligerent Parties would simply shed off any inhibitions in the conduct of hostilities.
Similarly, here he talks about how theoreticians and human rights law experts do not understand the purpose and use of LOAC - and indeed how their theories are not only wrong but ultimately destructive.
Frequently, there are passionate debates as to whether what we are doing in war is in full harmony with LOAC. As a rule, when the law is equivocal or controversial, the legal literature can become a useful tool in identifying and interpreting normative obligations. I myself regularly contribute to that literature, and I am not inclined to trivialize its potential import as a roadmap for practitioners. All the same, it is necessary to acknowledge the existence of a cottage industry of law review articles trying to recast LOAC, reconciling it with conditions of some fantasy land in which war can be conducted without putting any civilian in harm's way. These writings are produced not only by preachers of human rights ascendancy but also by LOAC theorists who are constantly citing each other without much concern for battleground realities (of which they seem to know very little). For persons familiar with general state practice, this is a matter of bemusement or perhaps even amusement. It is accordingly advisable to keep in mind that LOAC - just like other branches of international law - is created solely by states, in treaties or in custom. The legal chatter of armchair quarterbacks is no different from static in a telecommunications system. It must be separated from the genuine sound of law. 
How many times have we seen the media claim that what Israel does is "disproportionate" without knowing what that actually means in a legal sense?
Whereas a lot is being done by all modern armed forces to train soldiers, sailors, and aviators-especially officers of all ranks-in the intricacies LOAC, not enough is being done to instruct journalists as to what is permissible and impermissible in military engagements. Media reports are therefore frequently predicated on false assumptions as to the "do"s and "don't"s of warfare.

Dinstein talks a bit about how every new conflict spawns new areas of LOAC, with which Israel is unfortunately one of the leaders. Here he challenges the ICRC for not understanding that there is no clear distinction within armed groups between "civilian" and "militant."

[There is a]  broader challenge to LOAC presented by civilians directly participating in hostilities. The failure of an ICRC endeavor to engender a consensus on the range and repercussions of this omnipresent phenomenon has left much of the relevant law shrouded in doubt. Suffice it to mention the controversial ICRC advocated requirement of continuous combat function against three different backgrounds: 
(a) The incidence of the so-called revolving door of "farmers-byday, fighters-by-night" and their susceptibility to attack at a time slot in between engagements in hostilities. The ICRC looks at every fraction of DPIH [direct participating in hostilities] activity separately. I (and others like me) highlight the continuum. 
(b) The DPIH standing of members of organized armed groups who serve as cooks, drivers, administrative assistants, legal advisers, etc. In my opinion, it is wrong to discriminate between legal advisers in the government armed forces (like many present here)-who are categorized as combatants and are susceptible to attack-and those who are members of organized armed groups and are consequently exempt from attack according to the ICRC. For sure, organized armed groups are not inclined to issue membership cards. But for that very reason, the expectation that in the thick of battle a distinction can be made between actual fighters and accompanying support staff is illusionary. 
(c) The DPIH status of those who orchestrate behind the scenes the combat activities of others through military planning, training, and recruiting of personnel. Those who fire arms are often pawns manipulated by others who are literally calling the shots while purportedly belonging to a political rather than military wing of the organized armed group. The problematics of these and other outstanding DPIH issues is fraught with battlefield dilemmas that refuse to go away.

Dinstein is hardly a hawk. Even in this speech, he criticizes Israel's policy of demolishing terrorist houses as a violation of LOAC, although he understands that one must find disincentives for suicide attackers; he prefers sealing up the houses of their families instead.

Living in Israel, he knows how LOAC must evolve to handle new situations and that Israeli rights in war are no less than the rights of Palestinians or Hezbollah - something that eludes "human rights experts" like Ken Roth.

Jewish unity is the answer to the EU's kosher slaughter ban - opinion
Let’s not be fooled into thinking that banning kosher slaughter is the end of the story. In fact, many have noted that this decision represents a ‘slippery slope,’ bringing about the question of, ‘What next?’

Building a united strategy which combines effective use of the law, messaging, bottom-up and top-down activism, and local and global support will ensure that we do not have to find out what could have been next.

Israel’s Diaspora Affairs Ministry sees itself as a convener in this work. Jewish communal leaders, institutions, government officials and legal professionals – both in Europe and around the world – must work together under a shared plan of action, which includes:
• Calling out the hypocrisy of banning kosher slaughter – which shows mercy for the animal – while allowing hunting to continue
• Working effectively with governments
• Bringing together individual European countries and government leaders and offices from around the world, along with the Israeli government, to use diplomatic channels to engage with the European Union and other bodies
• Creating an effective media strategy
• Generating a shared voice to engage the public and leadership
Now is the time to join as a united Jewish coalition to ensure the strength and viability of European Jewry.
How Germany tricked Jewish organizations worldwide
When the German parliament labeled the Boycott, Divestment and Sanctions movement as anti-Semitic, it garnered the praise of Jewish organizations worldwide.

But despite the importance of the move, which influenced more European countries to adopt similar decisions, what remained hidden was the fact that the resolution had no legal and practical validity. It was merely a recommendation.

Besides the fact that many left-wing parties in the Bundestag voted against the decision, the initiative's very purpose was to block a more radical right-wing proposal that demanded a complete ban on BDS activities in Germany.

The vote drew immediate public criticism from BDS supporters, including Israelis, Jews, journalists, and the former Israeli ambassador himself. They claimed the decision was a violation of the principle of freedom of expression. It was also alleged that Israel forced the German government to silence the critics of government policy in Jerusalem, an argument that is anti-Semitic at its very core.

A week later, the Bundestag's Research and Documentation Services issued an opinion that the parliament's decision is legally invalid.

And that is how German authorities pulled off an ingenious move: on the one hand, they presented themselves as pioneers in the fight against anti-Semitism and the de-legitimization of Israel; on the other hand, their decision is void of any practical capability to fight the anti-Semitic boycott movement.

This is how good-old Germany has always operated: its official policy states that the existence and security of Israel is part of the nation's national interest; at the same time, it supports anti-Israel organizations with known ties to terrorists and consistently votes against Israel at the United Nations.
The BBC’s ‘Black Christmas’ is the least of our problems
As the late Rabbi Lord Sacks warned in speeches in the House of Lords in 2018 and 2019 on British anti-Semitism and global anti-Semitism: when anti-Semitism moves from the political fringes to a mainstream party – and when anti-Semites don’t think they are anti-Semites – we are all in serious trouble.

Anti-Semitism starts with Jews, but it never ends with Jews. And I’m afraid to say the churches on the whole are returning to their anti-Semitic traditions, particularly those represented by the World Council of Churches. See this piece by Melanie Phillips on the anti-Semitism of the WCC, and the pusillanimity of the senior clergy of the Church of England – my own faith community – towards BLM. As I wrote in a piece for The Algemeiner, the Anglican Communion, in cahoots with the Jihadists, is now leading what it calls Palestinian ‘Liberation Theology’, a Marxist movement that Pope John Paul II had the good sense to proscribe when it first appeared in the Sandinista movement and Roman Catholics of Nicaragua. Communism/Socialism is not the Way.

In 2004, the BBC commissioned a formal report – the Balen Report – following persistent accusations of anti-Israel bias. To date the BBC has spent about £330,000 of public money in legal costs to hide the report from the public. This cover-up is itself scandalous. The reasons for the BBC’s anti-Israelism, like that of French state TV (France 2), are multifarious, but one reason is that Western institutions are easily duped by Islamist propagandists fluent in the old colonial languages, and expert in feeding the liberal egocentrism of the West. Hence the BBC and France 2 report what their Arab hosts tell them, but fail to report the commonplace preaching and incitement of genocidal antisemitism in Arabic and Persian by clerics, politicians and media. Similarly, Qatar state TV, Al Jazeera, broadcasts democracy in English, but gives a weekly perch to the intellectual head of the Muslim Brotherhood Sheikh Yusuf al-Qaradawi to broadcast genocidal anti-Semitism in the form of fatwas against Israel, including advocating the use of Muslim children as suicide bombs.

I recently wrote a joint essay with the historian and Jerusalemite Dr Richard Landes partly on the dangers of this ‘lethal journalism’. Islamists are winning the cognitive war, and this results in an existential threat to us all, especially if the anticipated Farrakhan-loving Biden administration is lenient with Islamism and the nuclear ambitions of the Ayatollah. As it is, through its political proxy Hezbollah, Iran already has about 150,000 rockets hidden within the civilian populations in south Lebanon, all pointing at Israel to bring on the Shiite Apocalypse.

Richard Landes and I are frustrated that these really serious problems – the ticking time bombs – are being ignored by Western intellectuals and legacy media alike. Even many who claim to be battling anti-Semitism – including some Jewish leadership – get bogged down in pedantry and political correctness.

In sum, anachronisms and the colour of Jesus’s skin are not worth worrying about, rather we have some profoundly serious battles against anti-Israelism that we must take to BBC and the wider world. We must win, and we will.
